These Terms of Use (the "Terms") govern your access to and use of the websites operated by Effective Arts Labs ("Effective Arts", "we", "us"), including ealabs.io and book.ealabs.io (together, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Effective Arts Labs is a digital product studio based in Toronto and Montréal, Canada, providing business automation, web and mobile development, custom software, and related design and consulting services.
You may use the Site for lawful purposes only. You agree not to:
The content on the Site — including articles, guides, resources, and tools such as calculators — is provided for general information only. It does not constitute professional, legal, financial, or technical advice for your specific situation, and you should not rely on it as such. Results described on the Site (including examples in our portfolio and resources) are illustrative and do not guarantee similar outcomes.
Booking a discovery call through the Site is a request for a conversation, not a contract for services. You agree to provide accurate contact information and to attend or cancel scheduled calls with reasonable notice. We may decline or reschedule bookings at our discretion.
Any services we provide are governed by a separate written agreement, proposal, or statement of work between you and Effective Arts. If there is any conflict between these Terms and a signed services agreement, the services agreement prevails for that engagement. Nothing on the Site constitutes an offer capable of acceptance without such an agreement.
The Site and its content — including text, graphics, logos, illustrations, videos, page designs, and code — are owned by or licensed to Effective Arts Labs and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, revocable licence to access and view the Site for your personal or internal business use. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission. "Effective Arts", the EA monogram, and related marks are trademarks of Effective Arts Labs. Ownership of deliverables created for clients is addressed in the applicable services agreement.
The Site may link to or integrate third-party websites and services (for example, scheduling, analytics, and social platforms). We do not control and are not responsible for their content, availability, or practices. Your use of third-party services is governed by their own terms and policies.
The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Effective Arts disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Site will be secure, accurate, complete, or current at all times.
To the maximum extent permitted by law, Effective Arts Labs and its principals, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site. Our total aggregate liability for any claim relating to the Site will not exceed one hundred Canadian dollars (CAD $100). Liability arising under a signed services agreement is governed by that agreement. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
You agree to indemnify and hold harmless Effective Arts Labs from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site or violation of these Terms.
Our collection and use of personal information through the Site is described in our Privacy Policy, which forms part of these Terms.
We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Changes take effect when posted on this page, and your continued use of the Site after posting constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. You agree that the courts located in Toronto, Ontario have exclusive jurisdiction over any dispute relating to the Site or these Terms, and you attorn to their jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
